I had a permanent custody to the state trial at 9 am. It ran until 12:30. Mom in prison until late 2014. Grandmother, former legal custodian, in prison until 2018. Great grandmother, with no prior history with the case, visitation, or a motion for custody, was pulled in by defense counsel to present herself as a suitable placement.
The agency had spoken to her on a number of occasions, and although she is a delightful person, she has (1) way too many illnesses and prescribed medications, and (2) never expressed a serious desire to become the permanent caretake of this child. In fact, she and her fellow family members BELIEVED that the child's grandmother will get a judicial release and be ready to take the child back in early March 2015. Our statutory two years is up in mid February 2015.
The whole family thought, for some reason, that it was OK to have a 2 year old cerebral palsy child remain in the custody of the agency for a couple of years! Only to have a prison bird get out an take custody back.
So sad. They blame the agency. And are angry that there is a great therapeutic foster family caring for the child.
There is a whole lot more to this story, and I wish it could have been different.
I will await the written decision.
